Micro, Small and Medium Enterprises
(MSMEs) hold role important in the Indonesian economy, but they often face
challenge in protect asset intellectual, especially brand. Uncertainty law in

Registration in Indonesia in Providing Legal Protection for MSMEs
Law No. 20 of 2016

legal framework for trademark registration in Indonesia, with a focus on
protection and convenience for Micro, Small, and Medium Enterprises (MSMEs).
The Trademark Law regulates various aspects related to trademarks, including
registration mechanisms, protection, and dispute resolution.
In a global world
where MSMEs face increasingly fierce competition, legal protection for
trademarks is crucial to securing the exclusive rights of trademark owners.
With legal certainty, trademark owners can prevent malicious imitation and
infringement, and help consumers distinguish between genuine and counterfeit
products, thereby enhancing the competitiveness of MSMEs in the global market.
The Trademarks Act
provides a comprehensive definition of a trademark, covering various forms of
marks used in commerce to distinguish products and services. The importance of
distinctiveness in trademarks is emphasized in the law, which states that a trademark
must not be similar or identical to any other registered trademark.

consumer confusion and unfair competition. Trademarks with a high degree of
distinctiveness not only protect the rights of their owners but also help
consumers to clearly identify products. Thus, the Trademark Law contributes to
creating a fairer and more transparent business environment.
The role of
trademarks in the market is very important, serving as a means of
identification that distinguishes similar goods while providing information
about the quality and reputation of the product. Trademarks also serve as a
guarantee of authenticity, protecting consumers from counterfeit products.
Although trademarks cannot be enjoyed physically after purchase, their presence
adds value and satisfaction to consumers.
A trademark must
meet a number of basic elements to be considered valid, including the ability
to be represented and produced graphically by a legal entity or legal entity.
Thus, a trademark becomes a differentiation tool that not only helps in the
consumer decision-making process but also contributes to the protection of
consumer rights and the assurance of product quality.
Trademarks that meet
certain criteria are regulated by Law No. 20 of 2016 concerning Trademarks and
Geographical Indications as conventional trademarks, including two-dimensional
trademarks. However, with the development of technology, the Trademark Law also
accommodates the protection of three-dimensional trademarks, including digital
trademarks that can be presented in forms such as sound and holograms.
Trademarks play an
important role in trade activities, not only as a product differentiator but
also as an identity and tool that can influence consumer psychology. To obtain
legal protection, trademark registration is a strategic step, especially for Micro,
Small, and Medium Enterprises (MSMEs). The Trademark Law emphasizes that
trademark rights are only obtained when the trademark is registered, which aims
to prevent overlapping trademarks and increase the competitiveness of MSMEs.
The trademark
registration process involves a substantive examination to ensure that the
trademark is distinctive and does not conflict with existing trademarks. The
Trademark Law stipulates the criteria for trademarks that cannot be registered,
including those that conflict with state ideology, morality, or that may
mislead the public. Trademark registration follows a �first-time filing�
system, where exclusive rights are granted only to the owner of a registered
trademark, in accordance with Article 1 of the Trademark Law.
A registered
trademark receives legal protection for ten years from the date of filing, and
trademark registration serves as proof of ownership, a basis for refusing
registration of similar trademarks, and a deterrent against the use of
identical trademarks by others in the market. Thus, trademark registration is
essential to protect the rights of owners and maintain the integrity of
products in the market.
Law No. 20 of 2016
concerning Trademarks and Geographical Indications (Trademark Law) has provided
significant convenience for Micro, Small, and Medium Enterprises (MSMEs) in the
trademark registration process. One of the important steps taken is the simplification
of the registration procedure, where applications can be submitted
electronically through the Directorate General of Intellectual Property (DJIP).
This policy not only
accelerates access for MSMEs spread across various regions, but is also in line
with the government's efforts to digitize public services. Registered
trademarks not only serve as visual identities but also provide exclusive
rights protection for their owners, which is important in a competitive market
where MSMEs often lack sufficient resources to compete directly.
In practice,
although the Trademark Law stipulates that a registration application can be
rejected if filed in bad faith, there are often cases where applications from
such parties are still accepted. This illustrates the ambiguity in the
definition of good faith, which can lead to different interpretations between
the applicant, the Directorate General of Intellectual Property (DGT), and the
judge. To overcome this problem, clearer regulations are needed regarding the
criteria for good faith, so that the trademark registration process can provide
fair protection, especially for MSMEs who are highly dependent on trademark
registration to protect their businesses.
The Trademark Law
also establishes a mechanism for resolving trademark disputes that can be
handled through the courts or arbitration, with arbitration options being
faster and more affordable for MSMEs. The policies outlined in the Trademark
Law, combined with the support of the Job Creation Law, have a significant
impact on the economic value of MSMEs.
Registered
trademarks can be used as business assets and collateral to obtain business
capital, helping to facilitate the growth and sustainability of MSME
operations. Government support in simplifying procedures and reducing the time
required for trademark registration is essential to increase the
competitiveness of local products, both in the national and international
markets.
Legal experts
emphasize the importance of trademark protection for MSMEs, which not only
protects against counterfeiting but also increases long-term economic value
through market recognition and consumer loyalty. With more MSME-friendly
policies, it is hoped that more MSMEs will realize the importance of trademark
registration and utilize it to support the sustainability of their businesses
amidst increasingly fierce competition.
The Job Creation
Law, first issued as Law No. 11 of 2020 and later revised as Law No. 6 of 2023,
brings significant changes to the trademark registration process in Indonesia.
One of the most important changes includes a revision of the provisions on trademarks
that cannot be registered, with the addition of new criteria regarding
trademarks that "contain a functional form". In addition, the time
frame for completing substantive trademark examinations has been simplified,
with the maximum examination duration reduced to between 30 and 90 days,
depending on any objections.
This aims to
increase transparency and efficiency in the registration process, which was
previously hampered by complicated bureaucracy and long schedules. In addition,
the provision regarding the cancellation of trademarks for non-use within 18
months has also been removed, given the development of technology that allows
the issuance of certificates in electronic form with QR codes.
Amidst these
regulatory changes, many Micro, Small, and Medium Enterprises (MSMEs) still
face uncertainty and lack of awareness regarding the trademark registration
process and its long-term benefits. Research shows that although some MSME
respondents, such as the owners of Bakmi AHO and PT Apertura Digital Indonesia,
have well-known businesses, they have not officially registered their
trademarks due to lack of information and focus on short-term profits.
Positive examples
from MSMEs such as Awor Coffee and Simply Amelie show that after registering
their trademarks, they experienced a significant increase in income and legal
protection. Involvement in government programs that facilitate trademark
registration also helps improve MSMEs' understanding of the importance of
trademark legality. Overall, although the Job Creation Law makes it easier to
register trademarks, further education is needed for MSMEs so that they can
optimally utilize trademark protection in developing their businesses.
Trademark
registration is an important step for MSMEs in Indonesia to protect their
intellectual property and ensure their business continuity; however, many MSMEs
still face challenges in this process. For example, Bandha has not registered
their trademark because they are focused on ongoing projects, while Kaya
Leathers has experienced rejection of their trademark application due to
similarity to other trademarks, raising concerns about losing consumer trust.
The Central
Statistics Agency (BPS) noted the lack of specific data on MSMEs registering
trademarks and acknowledged that outreach related to trademark registration
needs to be improved. Although the Trademark Law provides legal protection and
simpler registration procedures through the Regulation of the Minister of Law
and Human Rights No. 12 of 2021 and the Job Creation Law, MSMEs still face
administrative challenges, including the complexity of the required documents.
Support from various
ministries and synergy between government agencies are needed to overcome these
challenges and raise awareness of the importance of trademark registration. The
existing regulations are expected to increase the number of trademark registrations
by MSMEs and support their economic growth, although challenges in outreach and
understanding remain obstacles that must be addressed.
Trademark protection
for MSMEs in Indonesia faces significant challenges, including limited access
to technology and infrastructure, as well as complex law enforcement issues
against trademark infringement. Although an electronic registration system has been
introduced through the Regulation of the Minister of Law and Human Rights No.
12 of 2021, not all MSMEs have adequate access. Trademark protection is not
only economically significant but also has social impacts, enabling MSMEs to
build reputation and innovation.
Philosophically,
MSMEs reflect the values of Pancasila and the 1945 Constitution, contributing
to social justice and people's sovereignty. In legal analysis, the theory of
justice, legal certainty, and responsive law provide a relevant framework for
evaluating trademark registration regulations. A registered trademark grants
exclusive rights to its owner and serves as evidence in disputes, while delayed
registration may result in detrimental disputes.
Therefore, it is
very important for MSMEs to register their trademarks as early as possible to
secure their rights and avoid potential disputes. In addition to exclusive
rights, trademark owners also have an obligation to actively use and renew
their registrations, making enforcement of rights through objection mechanisms
or litigation important to protect their interests.
Trademark owners,
especially SMEs, can avail of legal services to enforce their rights, such as
sending cease and desist letters to infringers requesting the cessation of
unauthorized use of the trademark, and if necessary, taking further legal
action in court. To this end, a thorough understanding of the rights and
obligations associated with trademark registration is essential, enabling SMEs
to take full advantage of existing protection mechanisms.
Trademark
registration provides significant benefits, such as exclusive legal protection
that prevents others from using a similar name or symbol, and serves as a
marketing tool that increases professionalism and consumer trust. Successful
examples such as "Kopi Lokal Sejahtera" and
"Handmade Craft Co." demonstrate how trademark registration can
increase competitiveness, expand market reach, and enhance customer loyalty.
However, many MSMEs face legal challenges in trademark registration, including
a lack of knowledge about the process and its benefits, and limited technical
support.
Complex registration
processes and bureaucratic red tape also pose obstacles, with many MSMEs
struggling to navigate without professional assistance. A lack of understanding
of the importance of trademark registration and difficulty in accessing legal
services can prevent MSMEs from fully taking advantage of the trademark

presence of MSMEs in the national economy contributes to job creation, local
economic stimulation, and Gross Domestic Product (GDP) growth, reflecting its
important role in the economy as a whole.
Given the vital role
of MSMEs in the economy, legal protection of their products and trademarks is
very important, although public awareness of this is still low, so that many
traditional products are targeted for imitation. Trademark protection is very important
because only rights holders can produce goods with registered trademarks, and
any unauthorized action can be considered a violation of the law with its
consequences.

Law is a significant step by the government to provide protection for MSMEs
through recognition of intellectual property in the form of trademarks, with
trademark certificates that function as proof of ownership that can be used in
disputes. To encourage trademark registration among MSMEs, the government has

coordination between various parties still needs to be improved for optimal

registration and protect their products and services. Law No. 20 of 2016 also pays
special attention to collective trademarks, which allows MSMEs with similar

legal uncertainty remains among MSMEs due to a lack of understanding of the
trademark registration process and ambiguity in law enforcement.

with business owners such as Bakso Ahok and Simply
Amelie revealed that although they recognize the importance of trademark
protection, they face challenges in understanding the registration procedures

strict law enforcement from the government to create a safer environment for
innovation and business growth. In other words, the legal uncertainty
experienced by MSMEs such as Bakso Ahok, Awor, and
others requires improvements to the registration system and legal protection to

trademark registration provides a significant competitive advantage. Business
actors such as Bakso Ahok emphasize that trademark
registration is not just a formality but a strategic step to protect the

financial losses. In contrast, actors who do not register their trademarks, such
as Awor, feel vulnerable to the risk of intellectual property infringement,
which reduces their market value and consumer trust.
Interviews with
other entrepreneurs, such as Simply Amelie and Kaya Leathers, revealed that
trademark registration helped them build a strong image in the minds of
consumers and opened access to a wider market. Although most MSMEs are aware of
the importance of trademark registration, many face confusion regarding the
registration process and costs, as well as a lack of clear information from the
government. Practical factors, such as costs and procedural complexities, often
act as barriers for them. However, government support through outreach programs
and incentives can increase MSME interest in registering trademarks. Overall,
trademark registration not only protects product identity but also has a
positive impact on consumer trust and the social and economic well-being of
MSMEs, making it important for them to obtain adequate legal protection.

among MSMEs, thereby increasing the competitiveness of their products in the
market.
The main challenges
faced by government agencies in the trademark registration process for Micro,
Small, and Medium Enterprises (MSMEs) include limited funding, human resource
readiness, lengthy registration procedures, and technical issues such as slow server
response on the registration website. Budget constraints hamper outreach on the
importance of trademark registration, leaving many businesses lacking adequate
information. In addition, the complicated registration process and high costs,
as well as a lack of understanding about trademarks, create legal uncertainty
for MSMEs.
To address these
issues, an ideal trademark registration model is needed to simplify the
process, reduce costs, and increase access and support for MSMEs. This model

model, it is hoped that MSMEs will find it easier to protect their products and
